Mumtaz, a former national athlete, said to have close links to Datin Seri Rosmah Mansor, appeared calm as she told the court her full name.

Khairil, who was Datuk Seri Najib Razak’s special officer when he was deputy prime minister, was soft-spoken when he identified himself in court.


Karpal said that he had already filed an affidavit for the appeal against the judge’s decision made this morning in refusing Anwar’s team access to Saiful’s witness statements to the police.


The veteran lawyer then requested for adjournment of the trial till tomorrow morning, adding that he had already filed notice of appeal together with notice of motion regarding the appeal against the judge’s decision.


Judge Datuk Mohamed Zabidin Mohd Diah then postponed the trial to tomorrow morning at 9am to hear Anwar’s applications of the stay on proceedings pending the appeal.


Anwar, the 62-year-old PKR de facto leader, is charged with sodomising Saiful at Unit 11-5-1 of the Desa Damansara Condominium in Jalan Setiakasih, Bukit Damansara here, between 3.01pm and 4.30pm on June 26, 2008.


The former deputy prime minister has denied the charge, describing it as “evil, frivolous lies by those in power” when the charge was read out to him.


He is charged under section 377(B) of the Penal Code and can be sentenced to a maximum of 20 years’ jail and whipping upon conviction. The trial is taking place 18 months after Anwar was charged in court in August 2008.


Anwar was charged with sodomy and corruption in 1998 after he was sacked from the Cabinet and was later convicted and jailed for both offences. He was freed in September 2004 and later resurrected his political career by winning back his Permatang Pauh Parliamentary seat in a by-election in 2008. The seat had been held in the interim by his wife.


He had earlier led the opposition coalition, Pakatan Rakyat, to a historic sweep of five states and 82 parliamentary seats in Election 2008.




Former national track queen Datuk Mumtaz Jaafar also made a brief appearance in the afternoon for identification by Mohd Saiful, who was formerly Anwar’s aide.

Today’s hearing began at 9.15am, with High Court judge Datuk Mohamad Zabidin Mohd Diah turning down the defence application for Mohd Saiful’s witness statements.

This was in relation to Karpal Singh having submitted yesterday, that the documents were needed because there were contradictions between Mohd Saiful’s witness statements and the sodomy charge framed against Anwar.

Mohamad Zabidin said: “I agree with Solicitor-General II Datuk Mohamed Yusof Zainal Abiden that although Anwar is charged under Section 377B of the Penal Code — even though Mohd Saiful claimed that the incident was non-consensual — it cannot be the basis for a hunch to say that the statements contradict his testimonies in court and therefore, they should be given to the defence for the purpose of cross-examination or for impeachment,” he said.

At this juncture, Karpal Singh alleged that the prosecution knew of the outcome, drawing the ire of Mohamad Zabidin who stood down proceedings to deliberate on possible contempt.

When court resumed, Karpal Singh clarified that Mohamed Yusof, who is heading the prosecution, had his submissions ready for a defence application for stay to file an appeal.

Mohamed Yusof countered that he had to be prepared for any circumstances.

“When the other party files any application, I have to anticipate and be prepared for what will happen. Thank God, I got it and luckily, I got it right,” he said.

The judge turned down Karpal Singh’s request for stay but in the afternoon, he granted it after the lead counsel filed a formal application, together with Anwar’s affidavit.

Mohamed Zabidin also granted Karpal Singh time to prepare his submission before the court resumed at 3.45pm.

The two sides will submit on the matter when hearing continues tomorrow. — Bernama
