Fake degree scandal rocks politics, some lawmakers may lose seat what about KAMAL?

ISLAMABAD: Scores of Pakistani lawmakers may lose their seats for allegedly lying about their academic credentials, a growing scandal that adds to the woes of the US-backed leadership as it struggles with Islamist militancy and a weak economy.

What began as accusations against a handful of lawmakers has mushroomed into formal legal challenges against up to 160 elected officials - more than 10 per cent of the country's federal and provincial legislators. Many are said to have claimed fake degrees to meet a previous requirement for holding office.

The Supreme Court has ordered the Elections Commission to vet the credentials of nearly all of the some 1,100 federal and provincial lawmakers. If enough lawmakers are found ineligible, there are rumblings that a midterm election may be needed.

The scandal has drawn some frustrated reactions from lawmakers besieged by an aggressive media.

"A degree is a degree! Whether fake or genuine, it's a degree! It makes no difference!" Baluchistan province chief minister Nawab Aslam Raisani, who claims a master's in political science, shouted at a gaggle of reporters today.

The controversy has its roots in a 2002 law imposed by former military ruler Pervez Musharraf that required candidates for office hold a bachelor's degree or equivalent. Musharraf supposedly wanted to improve the caliber of lawmakers, but critics said the move was more about sidelining certain opponents.

It also was undemocratic, critics alleged, in a country of 180 million where only 50 per cent of adults are literate. Traditionally, feudal ties or business success count for more in politics than academic achievement.

Seven other countries - including Chile, Nigeria and Tajikistan - have constitutional provisions specifying an educational qualification for candidacy to the lower house of the national parliament, said Pippa Norris, who teaches at Harvard University's John F Kennedy School of Government.

Pakistan's Supreme Court struck down the requirement in April 2008, but not before Musharraf allowed elections in February of that year. Analysts say many candidates apparently submitted fake degree papers to qualify for those races.

Many of the potentially fake degrees appear to have been claimed from Islamic seminaries, whose degrees are considered equivalent to a bachelor's in Pakistan. Other lawmakers, however, claim to have earned bachelors, Ph.D.s or master's degrees from institutions whose existence is difficult to verify.

A SYNDICATE run by Chinese nationals is selling fake degree certificates from three Singapore universities at between RM720 and RM9,600 via the Internet, reported China Press.

It added that the certificates are printed in Johor Baru.

China students of the National University of Singapore, Nanyang Polytechnic and Singapore Manage-ment University who fared badly in their examinations are said to have bought the certificates.

The newspaper highlighted an agent telling an undercover reporter that he could print certificates for graduate and post-graduate degrees, charging a 20% deposit and promising delivery in two weeks.

“Most of those who buy the certificates are from China as they cannot graduate but need to show proof to their parents,” said the agent.

LAHORE: An election tribunal of the Lahore High Court barred on Thursday two former lawmakers of Pakistan People’s Party from contesting by-elections.Nazir Ahmad Jutt and Allah Wasaya had recently quit their the National Assembly and Punjab Assembly seats, respectively, to avoid getting disqualified by the Supreme Court for possessing fake degrees.

But they filed nominations papers for by-elections for the seats vacated by themselves in NA-167 Vehari and PP-259 Muzaffargarh, which were challenged before the election tribunal.

Sajid Mehdi, a candidate from NA-167, who had filed a petition against Nazir Jutt, submitted that the respondent had got a fake bachelor’s degree from Al-Khair University in Azad Kashmir. On the basis of that degree Nazir Jutt contested the election in 2008 and won the seat.

The petitioner said the respondent had earlier contested the election of district nazim Vehari showing his qualification as a matriculate. Even the F.A. certificate used by him for admission to Al-Khair University was held by the Sargodha education board as fake.

Sajid Mehdi pleaded that Nazir Jutt was not qualified to contest the by-election under Article 62 of the Constitution.

Makhdoom Basit Sultan Bokhari, a candidate for the PP-259 seat, challenged the acceptance of Allah Wasaya’s nomination papers. He said the defendant resigned after his bachelor’s degree had been challenged in the Supreme Court.

He said the returning officer accepted the nomination papers without considering the fact that Allah Wasaya held a fake degree and violated Articles 62 and 63 of the Constitution.

The tribunal comprising Justice Nasir Saeed Sheikh, Justice Mansoor Ali Shah and Justice Anwar-ul-Haq allowed both petitions and barred Nazir Jutt and Allah Wasaya from contesting election.Pre-employment background checks or background screening is the process of compiling criminal, financial and commercial records of an individual. Mohan held a joint press conference with Olympia College’s academic director Chan Chee Seng, who confirmed that Kamalanathan had done a twinning programme with the institution.
Looking at the dates it is really weird! Chan said Kamal was a student with Olympia between 2003 and 2004. The search result from Edith Cowan says a conferral date of 25 Nov 2003. The date on Kamal’s “degree” states 23 Jan 2004. Why don’t they agree? Even if we overlook the difference it means that Kamal studied only 1 year at Olympia and EC to earn his degree. Can you get a degree in such a short period of time? Now only an official public statement by Edith Cowan University will clear the issue once and for all. What sedition !! That joker has a dubious/ questionable degree so what is the fuss of double checking it.

One way is to ask the “degree holder” to provide proof of his degree, the other is to search the register. The “degree holder” should have provide information like the name he use to sit for the exam etc.

4) How did Kamal earn a degree after studying less than a year?
5) Why has Olympia college no student record of this fellow?

The question is, who can provide better and fairer governance while giving you due respect? Since this election will determine a parliamentary seat, it is also about national issues.

An MP’s job is to represent you in Parliament, not take care of uncollected rubbish and street lamps. What is the purpose then of State Assemblymen and the Municipal Council then?

There are many instances where MIC did not stand up for your rights in Parliament, they were just not brave enough to confront big brother UMNO.

For example, what did MIC do in 1988 when they amended article 121(1A) of the Federal Constitution? This has led to numerous custody, body snatching and child custody problems when one parent converts. Because of this article, many cannot even get justice, never mind if MIC says that in 1988 it could not foresee such repercussions. But in December 2007, Opposition Leader Lim Kit Siang called on Gerakan and MIC leaders to propose at the Cabinet meeting that Article 121 (1A) of the Constitution be amended in view of the controversies relating to the burial of Muslim converts. He said the Cabinet should be bold enough to consider an amendment to rectify the injustices which were never intended to be created by Parliament when the constitutional amendment was enacted in 1988. Did MIC do anything at all about this?

Indira Gandhi took her fight to the civil courts to nullify her children’s conversion and to get custody. On March 11 this year, the Perak state High Court judge gave her custody of the youngest child, overturning the Syariah Court order. Her joy was however shortlived because the abovementioned article became a stumbling block.

This subservience by MIC has reached a state where even the MIC candidate picked to contest in Hulu Selangor is seen as meddling by UMNO. The question is, if MIC cannot even defend their right to pick a candidate, how can they defend your rights?

The Indians have largely voted for BN from independence until they joined a broadbased revolt and denied BN its two-thirds majority on Mar 08, 2008. Though MIC boasts about having 600,000 members, they could not even garner 200,000 of the popular vote. MIC suffered heavy losses but acted like it was only a temporary setback and gave vague promises to reform itself. Are you satisfied with the reforms so far?

Have they been able to be brave enough when certain factions within UMNO insulted the community? Despite incidents that degraded the Indian community like the Kugan case and the cow-head incident in Shah Alam,
the Indians in Bagan Pinang gave BN overwhelming support in the by-election. However, after that, we still have incidents like the PM’s special assistant saying Indians came here as beggars and numerous other statements that either went unpunished or unchallenged.

If BN wins in Hulu Selangor especially under the current circumstances, it is likely that UMNO will become even more arrogant.

The talk in the coffeshops these days is: Indian votes are cheap and easy. Just throw them some crumbs and no matter how you treat them, they will keep quiet.

The actions by some within UMNO recently and MIC’s inability to stand up to them shows that this is not merely talk.

MIC is fond of saying that though many Indian parties have come and gone, they are still standing since 1946. What they don’t tell you is MIC blocked IPF’s entry into BN and took credit for MMSP’s work in Bagan Pinang. If MIC was so effective, why did the current and former PM show open public support for MMSP?

MIC also talks about rejuvenating with a line-up of young people but the President and many delegates are way past their expiry date.

MIC will also point out that some Indians are unhappy with the Selangor Pakatan government. Granted, they are not perfect but you must ask yourself whether any Pakatan leaders made derogatory remarks and treated the Indian community with such disdain as some within BN?

Is the Selangor MB Khalid as arrogant and corrupt as Khir Toyo? The Pakatan government is two years old and promised to help all including Indians. MIC is 60 years old supposedly exclusively there to uphold the rights of the Indians. But beyond talk, they have not been able to show much results.

The MIC/BN representative P.Kamalanathan who was handpicked by UMNO with ZERO experience in Parliament unlike veteran Zaid Ibrahim who was one of the rare ones to resign from his position as a Minister because he was unhappy with the way Teresa Kok, Tan Hoon Cheng and Raja Petra Kamaruddin were arrested under ISA. Zaid did this because he was a man of principle.

P.Kamalanathan said this in his blog :
“The MIC is aware of the grave responsibility such a position entails as is doing and will continue to do all that is needed and that is best to further spur the growth of the Indian society in Malaysia. The party will continue to be the beacon of the community in safeguarding their interests and unearthing opportunities for the community’s social, financial, economic, cultural and academic well being.”

Is this not the same thing they repeated over the last 12 general elections over half a century? Look at the fate of our children today. Have your voices been heard? Do you want this to happen to your grandchildren as well? They may not be as lucky if you continue to succumb to BN like MIC.

UMNO will love to have such a candidate in Parliament who just maintains status quo and does not challenge them – what more when he owes his candidacy to UMNO – even if before this he could speak his mind it will be unlikely after this.

When you cast your ballot on April 25th 2010, please think carefully about the repercussions of your vote. This is your right as a citizen but this right also comes with a heavy responsibility.

I am not from any political party but just an ordinary citizen who wanted to share my opinion with you.
