as my point of view is concerned MALAYSIAN Democracy is a failed system. Even after 50 years of independence the issue raised in the election are water, power, road, DEVELOPEMENT. It is very shameful on part of our more illustrious political families and political leader. Still significant section of our population is living life like (before 50 years). No roads, No water No power this is state of our country and on other hand we are boasting about our economy or it is urban economy. In elections hardly 50% percent voters turnout and out of 50% party with 20% percent votes stakes claim to form government. Which is itself is selfexplanatory as dis is not a peoples rule not democracy where 80% of people opposing the ruling party & this kind of government can never take decision or form policies for peoples interest or in the in interest of nation but will only for their on seat and their associate. On February 10, the Supreme Court threw out yet another petition seeking to reinstate L K Advani as an accused in the trial of the conspiracy to demolish Babri Masjid. This is despite a host of circumstances pointing to the probability of Advani, NDA's prime ministerial candidate in the upcoming election, being involved in the conspiracy. Not the least of which was his notorious rath yatra in the run-up to the demolition. And the testimony of the IPS officer in charge of his security, Anju Gupta, stating that his speech on the spot minutes before the demolition had added fuel to the fire.
On February 13, in the first of the Nithari serial killing cases to be decided, a trial court pronounced death sentence on Moninder Singh Pandher for a murder that took place when he was far away in Australia. And for the murder of a girl who he did not even know. As the prosecution admitted, there was no evidence to suggest that it was at Pandher's instance that his servant Surender Koli had raped and killed 14-year-old Rimpa Haldar, the victim who lived in a slum near his house. Yet, Pandher was held to be a conspirator mainly because his sexual profligacy was found to have brought out depravity in his servant.
The two interpretations of criminal conspiracy could not have been more different: ultra liberal in the case of Advani and stretched in the case of Pandher. Neither interpretation seems justified in the given facts and circumstances. Both the interpretations raise questions about the rigor and detachment with which the judiciary at all levels performs its job.
hIS scientific definition of LAW science is that it is a never-ending contest between competing hypotheses whose falsity has yet to be proven. In short, there is no such thing as a scientific 'fact': there are only provisional theories which, inevitably, will have to be amended or even totally rejected one day, in the light of new theories which will take their place, till they in turn are displaced by newer discoveries which produce newer theories. In real science, the investigation is endless; the case is never closed. Closure belongs to the realm not of science but of dogma, which is the antithesis ofLAW science and is the cornerstone of superstition.
• Promoting a culture of money politics, political scandals and ‘rasuah’ practised by ‘well-intentioned’ BN leaders and politicians, their minions and cronies.
• Suppressing our fundamental Article 19 UDHR right to freedom of expression by a controlled media and draconian laws such as the Sedition Act, the Printing Presses and Publications Act, the Emergency Ordinance, the Internal Security Act (ISA), the Multimedia and Communications Act, the Official Secrets Act (OSA), the Penal Code and the Dangerous Drugs Act. These have inculcated media self-censorship and taught ordinary citizen to be silent in the face of the denial of our basic human rights and fundamental freedoms as well as our constitutional rights.
• Denying our human rights and fundamental freedom to assemble under Article 20 of the UDHR to peacefully express public objection to or protest at implementation of policies that have adverse effects on our lives including the price hikes of essential goods and services. We are told by the PM himself that peaceful public protests are ‘un-Malaysian’(unless these public protests are held by BN members) and that the government is agreeable to our suffering in silence.
• Closing an eye to brutality by police and other enforcement personnel from the Immigration authorities, Rela and MACC that have resulted in an increasing number of deaths in custody of suspects and the violation of the rights of those outside custody (ordinary citizens, opposition leaders, documented and undocumented migrants, asylum seekers and UNHCR registered refugees) in violation of Article 5 of the UDHR.
• Arbitrarily arresting and detaining people without trial to keep law and order and your attempts to stamp out illegal immigration. We are led to believe that we should preserve a xenophobic attitude towards migrants and that violations of human rights under Articles 3, 5,and 9 of UDHR are necessary for the preservation of law and order and national security.
( Article 3 – Right to life, liberty and security of person, Article 5 – No one shall be subjected to torture, inhuman or degrading treatment or punishment, Article 9 – No one shall be subjected to arbitrary arrest, detention or exile.)
• Denying the right to adequate health care and medical treatment (which is against Article 25 of the UDHR) particularly of those detained in immigration detention camps (IDCs), including migrant women and children, pregnant women and women with babies newly delivered. Being immigration detainees appears to justify the inadequacy of health care and medical treatment for those suffering life-threatening illness and disease, vulnerable infants, children and women. In your understanding these migrants are the second biggest threat to our national security and therefore should be shown no mercy or humanity. Their crime is to be found on Malaysian soil without legally recognised documents or being undocumented. How they came to be here or why they are here is totally irrelevant and immaterial, despite Malaysia’s ratification of the UN Convention on the Elimination of All Forms of Discrimination against Women (CEDAW) and the UN Convention on the Rights of the Child (CRC).
• Governing with a judiciary that is perceived to be less than independent and with a justice system that is seen to be subservient to the Executive. The judiciary, like most of the national mainstream media, is now perceived to be within the civil service of the Government.
• Ousting the Pakatan Rakyat-led Perak state government using sleazy tactics and money politics to entice three over-ambitious and power hungry Aduns who had got themselves elected on opposition party tickets. The Perak electorate are expected to accept or tolerate the violation of their civil and political rights enshrined in Article 21 of the UDHR.
• Allowing non-transparent government and the failing to consult the public before approving plans for mega projects that adversely affect ordinary citizens. The rakyat applaud you for these ‘white elephants’ although we have not yet seen any of the benefits derived from them, so far.
• Privatising public utilities and making the cost of living rise by leaps and bounds but paying little or no attention to the quality of services provided. This has caused a boom in the economy of particular industries to alleviate daily difficulties e.g. getting a clean water supply. Think of how many water filters are sold to ensure that homes can obtain clean, crystal-clear water through our taps. No doubt, the manufacturers of such devices are deeply grateful to you for bumping up their profits.
• Permitting environmental degradation and hill-slope building construction without guaranteeing the safety of potential occupiers and residents in the surrounding areas. We understand that the tragedies of Highland Towers and Bukit Antarabangsa (to name only two well-known high-rise disasters) have diminished in your political estimation and that it is now vital for you to support the demands of crony contractors and developers to boost profits in currently flagging economic circumstances.
• Sucking up millions of ringgit via the PKFZ debacle that may have been put to better use to improve the lives of millions of lower income and hardcore poor in the country through, say, the provision of low-cost housing, shelters for homeless people or provision and services for single-parents.
• Giving a share of our staple rice production to foreign investors to feed your cronies first while feeding the rakyat comes second. In your wisdom you advise ordinary citizens of average means to continue tightening our belts and be ever grateful to you for such well-intentioned advice. We will be entertained at the sight of your lavish banquets in five-star hotels and bungalow houses, your glamorous and fashionable clothes and accessories, your botox-ed and re-constructed faces and figures, your hip hairstyles and luxury cars. We will share in your laughter to forget our rumbling stomachs behind our tightened belts.
• Depleting our natural forests by permitting logging in Orang Asli and East Malaysian traditional customary land, adversely affecting their culture and traditional way of life. You continue to make your generous contribution to poverty and climate change causing natural disasters around the globe with your obsessive pursuit of profit.
• Refusing to accede to or ratify the remaining seven major international human rights treaties and the 1951 Refugee Convention, which will be treated the same way as the Cedaw and CRC you have in your wisdom ratified only on paper.
For all this and more, we thank you, our wise and well-intentioned government.
Our awareness of what we lack and our hope for a better future will one day bear fruit, although not from the tree you planted under whose overhanging branches we now stand.
We, the rakyat, will work hard at our planting and will surprise you one day with how well we have learned the lessons you taught us.

If ever you landed in a position where you have to settle any dispute in court, it would be better if you demand to settle the case by tossing coin!!
If you leave it to those corrupted idiotic judges, you will sure end up a looser!! You have at least 50% chance of winning your case if you flip the coin!
Idiots had been promoted over decent intelligent, experienced and law abiding judges. What we are currently experiencing are the results of years of such idiotic policies. The chicken has come home to roost.
All these started by Mahathir and now we have judges who dishes out idiotic judgements and insane decisions.
When idiots takes over the judicial system and enough of them are scattered over the Court's system, we are then endowed with a judicial system where no justice or fairness will ever be served, where decisions and judgements are tailor made to the needs and requirements of certain individuals without regards for the rule of law or justice nor fairness.
Mahathir have a lot to answer for and the current state of our judicial system (hell, even our whole democratic system of government) had been compromised/cancerised by this mad hatter.
If a citizen cannot hope to get justice in a judicial system, then, there could be no justice at all to the lay person. If the people do not stand up and be counted now, then, when injustices befalls upon you, it might be a bit too late for you and you will find out what it is like when justice deserts you with impunity.
Malaysians must stand up and voice their concerns loudly and unequivocally so that those in power will have no choice but to get rid of these idiotic and dangerous dirtbag judges who do not know how to or want to observe our rule of law.
Actions are needed now. Mere words are no longer of any value. Malaysians must save Malaysia,..........get rid of these compromised, tainted and idiotic judges! Truth be told, all the administrative systems of the government have been unprofessionally governed since 1970, the time when NEP was implemented.
Gradually and progressively, they have started to rot and rot until today - all in the name of Malay Supremacy. This siege mentality syndrome has made them, even the judges themselves, immune to public accountability even at the expense of taxpayers' money. They deem it's their right as sons of the soil.
It will take another half a century to undo this mis-governance.
For God's sake please don't talk about achieving a developed country by 2020.
No ifs, no buts! The time is now! Only a fair and transparent judicial system will ensure justice is available to everyone.

Karpal on behalf of Anwar submitted the papers in the English language.
The court under Abdul Malek threw it out because the appeal must be in the Malay language.
This Abdul Malek wrote his reasons in the ENGLISH LANGUAGE as to why he have to dismiss the appeal!
My guess is , even if the appeal was done in the Malay Language it will still be thrown out.
umno owns the judge.
Its beyond clear that these judges believe their primary mandate is not justice.
Their understanding is self-interest first and foremost, and aligning with umno authority is their ticket to status and wealth and self-esteem enhancement.
As these 3rd class justices have pretty much have amputated justice (not law), there are no longer a legitimate authority that our citizens (malays, chinese, indians) should mindlessly accept and adopt.
Its pretty scary to leave the governance, safety and security of your family and children in the tainted hands of these judicial degenerates.
I hope Malaysians have the resolve to stand up and push-back against this judicial and law-enforcement filth.

The court has dismissed Dato Seri Anwar Ibrahim’s suit against Dr Mahathir Mohamad based on the fact the suit was written in English. Is this really the reason? I can’t describe how ridiculous and idiotic this piece of court judgment can be. That suit was filed way back in January 2006. And now after all that many years the court has found the most obnoxious reason to dismiss the suit.
If this was the main reason why the suit was struck out then why did the court officials receive the suit in the first place. The receiving officers, the registrar and the whole lot involved in receiving suits at the court registry should have refused to allow the suit and instead should have thrown the papers straight out of the counter.
Why did the courts receive the papers after collecting all the filing fees? You mean to say English is an unheard of and an ununderstood language in Malaysia that even judges cannot make heads nor tails of what was written knowing fully well many of the judges received their legal education at one of the renowned inns in UK.
If that is their reasoning then there should be strict signages in all courts, from the Magistrates, Sessions, High Courts and right up to Federal Court that English is strictly forbidden and that lawyers are prohibited to speak in English. Anyone found to be speaking in English would be handcuffed and jailed.
This is indeed the last straw pulled by our so-called judges who have no qualms as to how foolish they look before the eyes of the public.
Listen you pathetic judges, if you have an ounce of decency left in you then stop making a fool of yourself. If you neither speak nor understand English in courts then how on earth do you refer to case laws published in UK or Australia or any of the commonwealth nations? If you don’t understand English then you have no right to sit there at the bench. Abdicate and get out of there as you are unfit to take a cent of our tax payers money! Understood?
Yes I am angry, sick and disgusted with the behavior of these uneducated so-called judges who bring shame and eternal damnation to this precious country of ours. Stop fooling our people and the people all over the world as if you are invisible and that Malaysia is a non-existent country with non-existent people.
Yes, I call you sick and dammed and you don’t deserve to survive on our money. Are you collecting your salaries from the toilet cleaner of the courts or from cronies of yours that you therefore have no regard nor respect for the people around. Oh you creatures of the damned, you shameless mongrels of the uninhabited jungles of the world, get out of the courts and go and mind what you are best suited for. Perhaps you should take the place of the toilet cleaners in the courts from whom you take your salaries from and do the cleaning job well before you get booted out of the cleaner job itself.
Have all you judges been writing your judgments in English or Bahasa? Answer me now. Can you dare defy me now? Are all the senior non-Malay judges in the Court of Appeal or the Federal Court been writing their judgments in Bahasa Malaysia? Has Justice Gopal Sri Ram been writing all his meticulously incised judgments in BM or in English? If so, then all those court judgments from High Court to Federal Court should be dubbed as invalid and should be struck out from courts and reheard once again. Oh hell behold, our judges of Malaysia have sunk to base levels of ridicule, outrageously disgusting and perversely insulting to human intelligence so much so it is time to abolish our entire judiciary and restructure them from ground zero.
And do you so-called judges in Malaysia leave the argument of the constitution through which you so disingenuously construct the slightest excuse to misinterpret the same to fit your whims and fancies to carve out a judgment to suit your cronies or your own personal interests? Enough is enough. Time you culprits stand up and get out of the sight of this sacred institution which is being funded by we the tax payers.
